The first baby powder cancer lawsuit was won in a South Dakota federal court in late 2013. Deane Berg, the plaintiff, sued Johnson & Johnson, Luzenac America and its parent company Rio Tinto Materials (talc mining companies) for negligence and failure to warn consumers of the risk of ovarian cancer from talcum powder dusting.
